Version: 2
Last updated: 3 September 2026
Applies to: the Thrive Android app (net.element22.thrive), the Thrive backend server software, and the primary Thrive instance operated by Element22.

  • Developer and publisher ("Element22", "we", "us"): Element22
  • Contact: thrive@element22.net
  • Governing law: Province of Ontario, Canada

1. Who you are agreeing with

These terms are an agreement between you and Element22, the developer and publisher of Thrive. They cover two things:

  1. The app itself — always, on every device it is installed on, whichever server it connects to.
  2. The primary instance — the Thrive backend Element22 operates, if that is the server you use.

Thrive is self-hosted software, so the backend your app talks to may instead be run by somebody else. If it is: that operator's service is not Element22's service. Element22 does not run it, cannot see what is on it, and is not responsible for it, for its availability, or for how that operator handles your data. Sections 3 to 8 and 10 to 15 still govern your use of the app itself. Your relationship with that operator is between you and them.

By creating an account, or by continuing to use Thrive after being asked to accept an updated version, you agree to these terms and to the Privacy Policy, which forms part of this agreement. If you do not agree, do not create an account, and uninstall the app.

2. Licence to use the app

Element22 grants you a personal, revocable, non-exclusive, non-transferable licence to install and use the Thrive app on devices you control, for your own use. Element22 and its licensors keep all rights in the software, its name and its artwork; nothing here transfers ownership.

You may not sell, rent, sublicense or redistribute the app as your own, remove its attribution, or attempt to derive source code from a distributed binary except where that restriction is unenforceable by law.

You may run your own backend instance — see §9.

3. Who may use Thrive

  • You must be at least 16 years old. Where the law where you live permits a younger user with verifiable parental consent, a parent or guardian must agree to these terms on your behalf and supervise that use.
  • You must be able to enter a binding agreement where you live.
  • Access to any particular instance is at that instance operator's discretion. Registration may be closed, and an account may be declined, suspended or removed under §12.

4. Your account

  • You are responsible for keeping your password (and, if you use it, your two-factor device and recovery codes) secure, and for everything done through your account.
  • Give accurate registration details, and keep your contact details current if you want to be able to recover access.
  • If you lose your password, your security questions, your recovery codes and your two-factor device at once, your account may be unrecoverable. An administrator can reset a password but cannot recover data only you could unlock.
  • Tell your instance's administrator promptly if you believe your account has been compromised.
  • Do not share an account or let someone else use yours.

5. Thrive is not medical advice

Thrive is not a medical device. It has not been reviewed, cleared or approved by Health Canada, the US Food and Drug Administration, or any other regulator, and it is not intended to diagnose, treat, cure or prevent any disease or condition.

  • Every figure Thrive shows — steps, calories, sleep and its stages, heart rate, HRV, readiness, effort minutes, recovery, training load, cycle predictions, body composition, BMI, nutrition estimates — is an estimate, derived from consumer devices and public food databases. It is not diagnostic, and it can be wrong.
  • Cycle predictions are a statistical guess from your own logged history. Do not use Thrive as contraception or as a fertility-planning tool.
  • The AI features produce automated suggestions from a general-purpose model. They can be confidently wrong. Treat them as a starting point for your own judgement, never as instruction.
  • Nutrition data comes largely from community-maintained and third-party databases and may be inaccurate or incomplete. Check labels yourself where it matters — allergens above all.
  • Thrive does not monitor you for medical emergencies and will not alert anyone on your behalf.

Always consult a qualified professional before starting or changing a diet, training or supplement plan, and especially if you are pregnant, have a heart, metabolic, respiratory or eating disorder, or take medication. If you think you are having a medical emergency, call your local emergency number.

Exercise carries risk. You take part in any activity Thrive suggests or records entirely at your own risk, and you are responsible for exercising within your own limits.

Never let Thrive distract you while you are moving. Do not interact with the app while driving, cycling, or crossing roads. Watch where you are going during a tracked activity.

6. Acceptable use

You agree not to:

  • Break the law, or use Thrive to harass, threaten, bully, stalk, defame, or discriminate against anyone.
  • Post or send content that is unlawful, hateful, sexually explicit, or that depicts or promotes self-harm, disordered eating, or dangerous weight-loss practices.
  • Upload another person's photo, health data or personal information without their permission.
  • Impersonate anyone, or misrepresent your connection to a person or organisation.
  • Attempt to access another user's account or data, probe or attack a server, disrupt the service, or bypass rate limits, authentication or privacy controls.
  • Scrape or bulk-collect other users' data, or use the API in a way that places an unreasonable load on an instance.
  • Falsify activity data to gain an advantage in challenges, games, leaderboards or XP — including data written by a script, a shaken device, or another device carried by someone else.
  • Resell access to an instance you do not operate, or use Thrive to build a competing dataset.
  • Introduce malware, or use the recipe-import, photo, messaging or update features to distribute it.

An instance's administrators can see that an account exists, its role and activity level, and can suspend or delete accounts.

7. Your content

  • You keep ownership of everything you put into Thrive: your logs, photos, measurements, posts, messages and workout data.
  • You grant the operator of the instance you use a limited, non-exclusive licence to store, process and display that content for the sole purpose of running the service for you — showing your photo to you, delivering a message to the friend you sent it to, including your step count in a game you joined. That licence ends when the content is deleted, subject to backups.
  • Element22 claims no ownership of your content, and no licence at all over content on an instance it does not operate.
  • You are responsible for having the right to upload what you upload.
  • Content you share socially (feed posts, messages, profile pictures, shared metrics) may be seen, screenshotted or copied by the people you share it with. Privacy settings control what is offered to other users; they cannot control what someone does with what they have already seen.
  • An instance operator may remove content that breaks §6, or that they are legally required to remove.

8. Third-party services and integrations

Thrive can connect to services run by other companies — Health Connect, Hevy, Open Food Facts, FatSecret, Firebase Cloud Messaging, MapTiler, and any recipe site you paste a link to. Those services have their own terms and privacy policies, they are outside Element22's control, and Element22 is not responsible for their content, accuracy, pricing or availability. Connecting one is your choice, and you must comply with that service's own terms — a Hevy integration, for example, requires your own valid Hevy subscription and API key.

9. Running your own instance

You may run the Thrive backend yourself. If you do:

  • You become the operator, and the data controller for every account on your server. You are responsible for your users, for the security of your server, and for complying with the privacy and consumer laws that apply to you — including publishing your own privacy notice (see Privacy Policy §19).
  • The server software is provided as is, with no warranty, no support obligation, no uptime commitment, and no guarantee of compatibility between versions, upgrade paths, or data migrations.
  • Element22 is not liable for anything that happens on your instance: data loss, a breach, downtime, a claim by one of your users, or a regulator's finding against you. You will indemnify Element22 as set out in §14 for claims arising from your operation of it.
  • Do not present your instance as operated, endorsed or supported by Element22, and do not use the Thrive name in a way that suggests it is.

10. Pre-release software

Thrive is under active development and is distributed for testing. Expect defects, features that change or disappear, migrations that fail, and — despite reasonable care — the possibility of data loss. Experimental features, the AI features especially, may behave unpredictably, may be enabled per account, and may be withdrawn without notice.

Keep your own copy of anything you cannot afford to lose. Settings → Account & security → Export my data produces one.

11. Availability and changes

  • Element22 may change, suspend or discontinue the app, the server software, the primary instance, or any feature of them, at any time, with or without notice.
  • No uptime, backup or data-preservation guarantee is given for the primary instance. It runs on self-hosted hardware, and may be offline for maintenance, hardware failure, or a power or network outage.
  • If the primary instance is to be shut down permanently, Element22 will make a reasonable effort to give notice in the app beforehand so you can export your data.
  • Newer app versions may stop working with an older server, and vice versa.

12. Suspension and termination

  • You can stop using Thrive at any time and delete your account from Settings → Account & security. Deletion is described in the Privacy Policy §16 and cannot be undone.
  • Element22 may suspend or terminate an account on the primary instance that breaks these terms, that puts the instance or its users at risk, or that it is legally required to act on. Where it is reasonable to do so, we will say why.
  • Sections that by their nature should survive termination — §2 (licence limits), §5 (disclaimers), §7 (content), §9 (self-hosting), §13 (warranties), §14 (liability and indemnity), §16 (law) — continue to apply afterwards.

13. Disclaimer of warranties

To the fullest extent permitted by law, the app, the server software and the primary instance are provided "as is" and "as available", without warranties or conditions of any kind, whether express, implied or statutory — including any implied warranty of merchantability, fitness for a particular purpose, durability, accuracy, title, quiet enjoyment, or non-infringement.

Element22 does not warrant that Thrive will be uninterrupted, error-free, or secure; that its measurements, estimates or AI output will be accurate; or that data will not be lost.

Some jurisdictions, including Ontario under its consumer protection legislation, do not allow certain warranties to be excluded. Where that is so, those exclusions do not apply to you, and any implied warranty is limited to the shortest period the law allows.

14. Limitation of liability and indemnity

To the fullest extent permitted by law:

  • Element22 is not liable for indirect, incidental, special, consequential, exemplary or punitive damages; for lost profits, lost data, or the cost of substitute services; or for injury, illness or death arising from your use of Thrive or from reliance on the figures, estimates or suggestions it produces — whether the claim is in contract, tort (including negligence), statute or otherwise, and even if Element22 was told such damages were possible.
  • Element22's total aggregate liability for all claims relating to Thrive is limited to the greater of (a) the amount you paid Element22 for Thrive in the twelve months before the claim, which for a free app is nothing, and (b) CAD $100.
  • You will indemnify and hold Element22 harmless from any claim, demand, loss or expense (including reasonable legal fees) arising from your breach of these terms, your misuse of Thrive, content you upload, or — if you run one — your operation of your own instance.

Nothing in these terms excludes or limits liability that cannot be excluded or limited by law, including liability for fraud, or for death or personal injury caused by negligence. If any part of this section is unenforceable where you live, it applies only to the extent permitted, and the rest stands. You keep any statutory consumer rights you have.

15. Changes to these terms

These terms may change as the software changes. When the change is material, the Version number at the top increases and Thrive asks you to accept the new version before you continue using the app. Continuing to use Thrive after accepting means you agree to the updated terms; if you do not agree, delete your account and uninstall the app.

16. Governing law

These terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable there, without regard to conflict-of-law rules. The courts of Ontario have exclusive jurisdiction over any dispute — except where the law where you live gives you the right to bring a claim in your own local courts, which it may if you are a consumer.

17. Miscellaneous

  • If any provision is found unenforceable, the rest stays in force.
  • A failure to enforce a provision is not a waiver of it.
  • These terms, together with the Privacy Policy, are the entire agreement between you and Element22 about Thrive.
  • You may not transfer your rights under these terms. Element22 may transfer its rights and obligations, on notice in the app.
  • These terms are drawn up in English, and the English version governs. Les parties ont exigé que cette convention soit rédigée en anglais.
